Terms of Service

1. Acceptance of Terms

By using Toki, you agree to these terms of service. If you do not agree, please do not use the application.

You must be at least 16 years old to use Toki. This age requirement is consistent with LinkedIn's minimum age requirement and GDPR provisions.

2. Service Description

Toki is a native macOS application that allows you to write, schedule, and automatically publish posts to LinkedIn. The app runs in the background and publishes on time. The service is provided "as is" and we do not guarantee uninterrupted availability.

3. User Responsibilities

You are responsible for the content you schedule and publish through Toki. Content must comply with LinkedIn's terms of service and applicable laws. Toki enforces LinkedIn best practices (max 3 posts/day, 12-hour gap) to protect your account.

You agree not to: (a) use Toki to send spam, misleading content, or content that violates LinkedIn's terms; (b) attempt to reverse-engineer, decompile, or disassemble the application; (c) use automated tools to exploit or abuse the service; (d) share your account credentials or Pro subscription access; (e) use the app to harass, defame, or infringe on others' rights.

4. Subscription and Payment

The Free plan includes 20 posts/month, 5 carousels/month, and all core features — with no time limit.

The Pro plan is available at $1.99 USD/month (price may vary by country and currency, as determined by Apple) as a monthly auto-renewable subscription, processed through the Apple App Store. You can cancel at any time from Settings or the App Store. Pro access stays active until the end of your current billing period. After cancellation, you revert to the Free plan. Your data is never deleted.

Toki never sees, stores, or processes your payment information. All payments are handled entirely by the Apple App Store.

Refunds: All subscription payments are processed by Apple. Refund requests must be submitted through Apple's support channels. Invent Better does not process refunds directly. Visit reportaproblem.apple.com to request a refund from Apple.

5. Intellectual Property

Toki and its content (logo, design, code) are the property of Invent Better. You retain all rights to the content you create and publish through the application.

6. Apple App Store Terms

Toki is distributed through the Apple App Store. By using Toki, you also agree to Apple's standard End User License Agreement (EULA). The following terms apply:

(a) License scope: The license granted to you for Toki is limited to a non-transferable license to use the application on any Apple-branded products that you own or control, as permitted by the App Store Terms of Service.

(b) Maintenance and support: Invent Better is solely responsible for providing maintenance and support for Toki. Apple has no obligation to provide any maintenance or support services.

(c) Warranty: In the event of any failure of Toki to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to Toki.

(d) Product claims: Invent Better, not Apple, is responsible for addressing any claims relating to Toki, including product liability claims, any claim that Toki fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.

(e) Intellectual property claims: In the event of any third-party claim that Toki infringes that third party's intellectual property rights, Invent Better, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim.

(f) Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms of Service. Upon your acceptance of these terms, Apple will have the right to enforce these terms against you as a third-party beneficiary.

7. Third-Party Services

Toki integrates with third-party services including LinkedIn, Firebase, RevenueCat, and optionally Canva. Your use of these services is subject to their respective terms of service and privacy policies.

Toki's functionality depends on the availability of LinkedIn's API. We are not responsible for changes to, interruptions of, or discontinuation of LinkedIn's API or services that may affect Toki's ability to publish posts. If LinkedIn modifies its API in a way that affects Toki's functionality, we will make reasonable efforts to update the app, but we cannot guarantee uninterrupted service.

8. Termination

You may stop using Toki at any time by deleting the application and your account. We reserve the right to suspend or terminate your access to Toki if you violate these terms, engage in prohibited conduct, or if continued service is no longer feasible.

Upon termination: (a) your right to use Toki ceases immediately; (b) you may delete your account and data through the app before uninstalling; (c) any active Pro subscription should be cancelled through the App Store to prevent further charges.

9. Warranty Disclaimer

TOKI IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT TOKI WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE MAKE NO GUARANTEES REGARDING THE RELIABILITY OF LINKEDIN'S API OR ANY THIRD-PARTY SERVICE THAT TOKI DEPENDS ON.

10. Limitation of Liability

Invent Better shall not be liable for any indirect, incidental, or consequential damages arising from the use of Toki, including but not limited to loss of data or business interruption.

11. Indemnification

You agree to indemnify and hold harmless Invent Better, its owner, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of Toki; (b) content you publish through the service; (c) your violation of these terms; or (d) your violation of any third-party rights, including LinkedIn's terms of service.

12. Modification of Terms

We may update these terms from time to time. When we do, we will update the "Last updated" date at the top of this document. For material changes, we will notify you through the app at least 14 days before the changes take effect. Your continued use of Toki after the effective date constitutes acceptance of the updated terms. If you do not agree to the updated terms, you should stop using Toki.

13. Governing Law

These terms are governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of Toki shall be subject to the exclusive jurisdiction of the courts of France.

If you are a consumer in the European Union, you also benefit from any mandatory provisions of the law of your country of residence. Nothing in these terms affects your rights as a consumer under applicable EU consumer protection legislation.
